What is Copyright?

Copyright is a statutory Intellectual Property Right that protects original literary, artistic, musical, dramatic and certain other creative works. In India, copyright is governed by the Copyright Act, 1957, together with the Copyright Rules framed thereunder.

The primary objective of copyright law is to encourage creativity by granting creators certain exclusive rights over the use of their original works. These rights generally include the right to reproduce, publish, distribute, communicate to the public, adapt and translate the work, subject to the provisions of the applicable law.

Copyright protection extends only to the expression of an idea and not to the idea itself. Therefore, while concepts, methods and facts are generally not protected, the original manner in which they are expressed may qualify for copyright protection.

In India, copyright generally comes into existence automatically upon the creation of an eligible original work. Registration is not mandatory for the subsistence of copyright. However, a Copyright Registration Certificate may serve as prima facie evidence of ownership in appropriate legal proceedings.
